The court ruled unanimously that officials can be deemed "state actors" when making use of social media and can therefore face litigation if they block or mute a member of the public. The court held that conduct on social media can be viewed as a state action when the official in question "possessed actual authority to speak on the state's behalf" and "purported to exercise that authority." While the officials in both cases have low profiles, the ruling will apply to all public officials who use social media to engage with the public. The cases raised the question of whether public officials' posts and other social media activity constitute part of their governmental functions. The court is wrestling with a whole series of social media-related free speech issues in its current term, which runs until June.

In celebration of its annual Lobsterfest, Red Lobster is giving 150 winners an “Endless Lobster Experience,” a two-hour complimentary feast of unlimited lobster, two sides and Cheddar Bay Biscuits. But the Endless Lobster Experience comes at a tumultuous time: Red Lobster reported a record $12.5 million operating loss in the fourth quarter of 2023. And in January, minority investor Thai Union Group announced its intent to exit Red Lobster, citing a $19 million loss from Red Lobster across the first nine months of 2023. Starting February 20 and while supplies last, 150 winners will have a chance to enjoy Red Lobster’s free feast. The chance to win the Endless Lobster Experience will be advertised through Red Lobster’s social media channels, including Facebook, X, Instagram and TikTok.

A TikToker who lives in a housetruck in the woods showed viewers how she washes her hair during winter months. Winters are the hardest part about living in a housetruck, Kai told BI — and one struggle in particular riveted viewers recently. AdvertisementBut some people — including one top-voted commenter — criticized her for her use of commercial hair products. While it's not an excuse for using conventional products, Kai told BI her overall lifestyle is "much more eco-friendly than … most other people." Nevertheless, she solicited recommendations for eco-friendly hair products that were affordable and accessible in Canada.

Red Lobster introduced a $20 all-you-can eat shrimp promotion that backfired. They're clearly seeking value, a Red Lobster exec said. AdvertisementTheir generosity backfired, as the chain underestimated the number of diners hunting for dining deals amid rising menu prices. Though inflation is slowing, menu prices remain on the uptick, according to new federal data released in November. Ultimately, $20 for endless shrimp was too cheap for Red Lobster.

Business tends to slow down at Red Lobster locations during the third and fourth quarters, so its parent company, Thai Union, launched a new promotion. For $20, customers could eat as much shrimp as they wanted. The idea was to bring some traffic,” Garnier said on the call. It’s become one of the most iconic promotions at Red Lobster, Garnier said, but to keep it on the menu there has to be some changes. And what is the price point we’re offering for this promotion,” Garnier said.

Zalando packaging from an online delivery is seen discarded in a cardboard box in Galway, Ireland, August 27, 2020. Zalando now expects 2023 revenue to fall between 0.5% and 3%, having previously guided to a 1% decline at worst. An unusually warm September weighed on sales of autumn and winter clothes, Zalando said, exacerbating the impact of weak consumer sentiment. Gross merchandise volume - a measure of sales on the platform by Zalando and partner brands - fell by 2.4% from a year ago. The company's market value has dropped over the past two years as shoppers, freed from pandemic restrictions, returned to stores and ordered fewer clothes online.

The Authority of Law statue is seen outside the U.S. Supreme Court at the start of the new term in Washington, U.S., October 2, 2023. The Supreme Court is tasked with deciding whether the public officials engaged in a "state action" in blocking critics from social media accounts or were merely acting in their personal capacity. The justices also are due to decide other important cases involving speech on social media during their current nine-month term. One involves a challenge to Republican-backed state laws limiting the ability of social media platforms to remove or moderate content deemed objectionable or misinformation. Circuit Court of Appeals agreed, ruling that Zane and O'Connor-Ratcliff had presented their social media accounts as "channels of communication with the public" about school board business.

Blocking users is a function often employed on social media to stifle critics. The justices, hearing about three hours of arguments, focused on spelling out the circumstances for deciding whether public officials were acting in their personal capacity when blocking critics or engaged in a "state action." Conservative Justice Samuel Alito cited a hypothetical town manager who puts a municipal seal on his own social media page and tells citizens to express their views. Under this test, Mooppan argued, the social media activity of his clients was not governmental. Some justices asked whether requiring public officials to include disclaimers on their personal pages making clear their social media activity is not governmental would help disentangle their private and public capacities.

Worldline's (WLN.PA) stock slide, which saw around $4 billion wiped off its market value, is the latest wake-up call. COMMISSIONS CUTRevenue growth has suffered at payments firms as inflation has force European consumers to spend less, while investors fret about the euro zone slipping into recession. Some analysts say payments firms have also been caught napping, after a period of growth during COVID lockdowns. In a further sign of investor wariness, venture capital investment flows into European payment firms have also dried up. Now, it may leave private equity investors to pick up the pieces for payment service firms, analysts said.

H&M shares jump 11% as summer collection boosts profit

Sales from June 1-27 were up 10% from a year earlier, a good sign for the start of H&M's third quarter. The womenswear collection drove the boost in sales, Helmersson told a news conference. Shares in the world's second-biggest fashion retailer jumped 11% to hit their highest level since February 2022. The stronger-than-expected profit and inventory position helped investors digest a weaker margin of 8.2% for the second quarter, down from 9.2% a year earlier. H&M last year announced layoffs and other cost cuts that it said would help it reduce costs from the second half of 2023 onwards.

As sales decline, Adidas faces pressure to find Yeezy fix
  + stars: | 2023-05-04 | by ( Helen Reid | ) www.reuters.com   time to read: +3 min
Gulden in March said the company could donate the proceeds of the Yeezy sale to charities, but Adidas has given no updates since. The Anti-Defamation League, an international Jewish non-governmental organisation based in New York, told Reuters it "stands ready and prepared to work with Adidas". The American Jewish Committee met with Adidas executives in December to discuss their commitment to reject antisemitism. Shareholders want Adidas to draw a line under the Yeezy episode and develop ways to reboot the brand. "Being successful with Yeezy probably made Adidas lazy on finding other growth drivers," said Cedric Rossi, nextgen consumer analyst at Bryan Garnier in Paris.
CNN —“Pretty, are you sitting down?” South African soprano Pretty Yende was performing in Vienna last December when she received a call from her manager. She had just been booked for the biggest gig of her life: a performance at the coronation of King Charles III. As one of three soloists at the ceremony, it’s thought that Yende is the first African to be invited to perform solo at a British coronation. The coronation will not be the first time King Charles has watched Yende perform; he saw the soprano sing at the Royal Philharmonic Orchestra’s 75th anniversary gala, held at Windsor Castle in April 2022. Pretty Yende performs in "Lucia Di Lammermoor" at the Bastille Opera House in Paris in October 2016.
WASHINGTON, DC - APRIL 19: The Supreme Court of the United States, on Wednesday, April 19, 2023 in Washington, DC. But the legal dispute is the same: Can blocking someone on social media give rise to a free speech violation under the Constitution's First Amendment? It's a recurring question that has arisen at all levels of government as elected officials increasingly use social media to interact with voters. The appeals court concluded that the elected officials were acting in their official capacities and that social media accounts are akin to a public forum. The court also rejected the officials' argument that their social media pages were not official channels for members of the public to communicate with the government.
